We’ve written many times about how important it is to have a lawyer’s help when filing for bankruptcy. Those who represent themselves are less likely to receive a discharge of debt and might make an error that causes their case to be dismissed.

File for Chapter 13

In a Chapter 13 bankruptcy, a person’s legal fees can be folded into a payment plan that lasts three to five years. This means that the debtor does not need to have the money upfront but gets time to make payments.

However, Chapter 13 is not for everybody, and nobody should file for Chapter 13 simply because they don’t have the money upfront to pay for a Chapter 7. Of the two, a Chapter 7 bankruptcy is much faster and is the more sensible choice for many people. Unfortunately, all unsecured claims get eliminated in a Chapter 7, which would also include a debtor’s contract to pay their lawyer. For this reason, a debtor needs money upfront before filing for Chapter 7.

Come Up with a Payment Plan

A bankruptcy attorney might agree to let a debtor pay in installments. Of course, all installments need to be paid before the case is filed, otherwise whatever remains unpaid can be wiped out in the bankruptcy.

Save the Money

Another option is to simply save as much as you need to pay your lawyer and any court costs. You can save money in the following ways:

  • Cut back on expenses. Many people can easily give up on their morning coffee or gym membership to save money. With the coronavirus, many people are eating more at home anyway, which helps lower the cost of living.
  • Pick up a part-time job. A side hustle could net you $100 or more each week.
